DIN Deactivated due to non-filing of DIR-3 KYC

Dear Members,

Request your opinion on the following issue :

a. A Managing Director's DIN is deactivated due to non-filing of DIR-3 KYC but he  continues as Managing Director of the Company. 

(fyi ,The issue of deactivation was due to IT portal returning inconsistent info against the Director for which reason DIR-3 KYC was not successful and eventually got deactivated) 

In the above instance, can the Managing Director be able to sign the Financial Statements / Participate in BM and AGM of the Company ?

For filing the respective annual compliance form with the ROC, another active director shall be authorised to file to overcome any filing issue with ROC

Please provide your valuable opinion stating any section which constrains a deactiviated MD from signing of the Financial Statements, etc.
