Clarification required on filing of SPICe 32 with SPICe 33 and 34 in case of foreign subscribers

Dear Members,

We have filed the form SPICE 32 for the incorporation of a new company. The same form was objected by the MCA with the objection as follows: 

Please submit e-MOA and e-AOA, since the subscriber sheets of MOA and AOA are signed in India. Also detached physical copy of MOA and AOA from form SPICE 32.

We have try to upload the SPICE form 32 along with SPICE 33 and 34 but the error is coming as "For foreign subscribers/non-individual subscribers , file form SPICE 32 individually without linking with any other forms".

We had contacted with the MCA help desk and raised the ticket also for the same but no feasible solution has been given by them. Today, I had a call with the MCA help desk and they informed us that MCA has told to submit SPICE 32 only along with a clarification letter stating that there is a technical issue on the MCA portal.

Please note that the last date for the re submission is already gone on 26.07.2017, but the status is still "required re -submission"

Please suggest an alternative which we can follow to upload this form on urgent basis.

Dear Devansh,

In spice 32 resident status filed by you of subscriber is in India or outside India?

If residing outside India that subscriber sheet can not signed in India. So either change current resident status to India then form e-MOA and e-AOA will be uploaded or change in subscriber sheet that signed outside India in this case subscriber sheet need to be attested in the country it is signed then physical copy of e-MOA and e-AOA will be accepted.

In the case of Foreign subscriber

You need to only prepare SPICE-32(Read help kit of Spice 32)

AND

moa and AOA should be attach.in PDF format in Spice 32

Like at the time of file INC-7

In case of foreign subscriber signing documents in India then you have to submit 

1. Business Visa 

2. Passport consisting stamp of Journey to india

3. Proof of arrival in India

If documents are signed by subscriber outside India then all documents signed by subscriber needs to be appostiled or  appostiled and notorized, as the case maybe depending on the country of his origin.
