Terminal excise duty is Central Excise Duty, if any paid on the goods supplied to Deemed Exports.
 
For procedure please refer Page No. 126 of the Handbook of Procedures (Vol. I) 27th August 2009 - 31st March 2014. Also page no. 99 of the Foreig Trade Policy 2009-14.

Terminal Excise Duty refund may be availed upon our supplies provided the recipient of the goods, does not avail the CENVAT credit/rebate on such goods. Similarly supplies will be eligible for deemed exports drawback on the Central excise paid on inputs/components, provided CENVAT credit facility/rebate has not been availed by the applicant.
 

Supplies from the DTA to EOU units will be regarded as 'deemed exports' and, domestic suppliers, will be eligible for the following entitlements:-

(i) Reimbursement of Central Sales Tax;

(ii) Exemption from payment of Central Excise Duty on all goods as per entitlement under paragraph 6.2 of the policy.

(iii) Discharge of export performance (EP), if any, on the supplier.

(iv) Reimbursement of Duty paid on fuels procured from domestic Oil Companies, by the Development Commissioners of the concerned Zone as per the rate of drawback notified by the Directorate General of Foreign Trade from time to time.

(v) Advance license for Intermediate Supply/Deemed export

(vi) Deemed Exports Drawback

(vii) Refund of Terminal Excise Duty.

 

DEEMED EXPORTS

 

“Deemed Exports" refers to those transactions in which the goods supplied do not leave the country and the payment for such supplies is received either in Indian rupees or in free foreign exchange.

 

Deemed exports shall be eligible for any / all of the following benefits in respect of manufacture and supply of goods qualifying as deemed exports subject to the terms and conditions as given in Handbook (Vol. I) viz.:--

                                 i.            Benefit of duty free imports of inputs;

                               ii.            Refund of Terminal Excise Duty;

 

The application form as 'Appendix 12B' is enclosed herewith for refund of terminal excise duty.
