RUN-Name approval market as sent for resubmission

Dear Members,

I applied for a name "RR Ventures Private limited" and got this mail from MCA with following remarks

"Proposed name(s) include(s) the word(s) "RR"  which is/are a registered trademark under Class 36 & others  is/are

undesirable as per Rule 8A(1)(b) of Companies (Incorporation) Fifth Amendment Rules, 2019. Further, proposed name(s)
is/are identical with /resemble(s) too nearly to the name of an existing company “RR REALTY VENTURES LLP" & others.
Hence, undesirable as per the provisions of Section 4(2)(a) of the Companies Act, 2013 read with Rule 8(2) of
Companies (Incorporation) Fifth Amendment Rules, 2019. Submit NOC from the concerned body corporate through BR along
with PAN of the authorised signatory & body corporate. This is essential to differentiate genuine cases from cases
of counterfeit signatures/ documents observed these days.

The defects or incompleteness in any respect in this eForm as noticed by the Registrar have been placed on the
Ministry website ( www.mca.gov.in). In view of the above, you are therefore, directed that this eForm should be
resubmitted  complete in all respects by 27/02/2021 failing which the eForm shall be treated as invalid and shall
not be taken on record or transaction shall be cancelled.

Kindly make sure that all the information to be given while resubmitting the form are true and complete as user will
not be given any further chance to rectify the details per rule 10 of the Companies (Registration offices and Fees)
Rules, 2014."

Pls guide what do i need to reply or how can i resolve this issue

Hi,

Please note the only possibility to get this name is as follows:

1. If the trademark RR is registered in the same class in which you intend to work then you need to have permission via NOC from these people; or

2. This RR trademark belongs to you and attach the proof.

If both is not possible then search for the other name.

Obtaining noc from the existing LLP is difficult to obtain unless you know the directors personally.

Try adding name of the state or any activity (eg -infratech ) if possible to your proposed name and resubmit.
