Delay in Filing Form INC 22 beyond 3 years

Hello,

A private company, incorporated during 2014 had still not filled form Inc 22 post incorporation and now when they filled form the same was marked for re submission with reason:

"The form is filed beyond the period specified in section 12 r/w section 403(1) of the Companies Act, 2013.Compliance as per section 12(8) r/w 403(2) is required. "

Can anyone guide me the process needs to be followed for approval of the said form.

apply for condonation of delay u/s 460 of the Companies Act, 2013.

1. You have to file Form CG-1 first. wait for its approval.

2. File INC-28.

and then attach the SRN of Form INC-28 in the Form and then resubmit it.

Do you have any idea that whether CG will call for hearing or not? and approx. how much amount will be charged as compounding fees apart from Form fees?

depending on the authorised capital of the company. the fees for the form is high.

download the help kit of the form, see the fees for the form.

There is no hearing for the same.

Plus in my case approval for form cg-1 came in 2-3 months.
