There is one of our case that is going on in RD Office in delhi, One of private company Auditor is not giving NOC of his resignation. Company wants to remove him and he has not audited annual accounts also of year 2015 end so that way filings were not done this year and AGM was also not held. I have filed forms for extension of AGM, but it was rejected by ROC.
If at time of hearing, if now that Auditor agrees to provide Audited Accounts of year 2015, then how can we fix date of AGM and can we escape penalty due to delays in filings of annual forms.
