Dear All,


I am practising Advocate in Madras High Court and I have completed my CS course.

Kindly high light whether I can be a member in ICSI and simultaneously practise as CS  by getting a certificate of practise issued in my favour or 

Shall i can only be a member in ICSI or

I cannot become a member in ICSI or 

Do i have to surrender my practise to concerned Bar Council.

Kindly highlight the pros and cons of the above to and advise me the best option.

You can practice single profession at a time, CS or Lawyer. You have to surrender bar council registration before taking CP for CS.

Also read CS Act for more details and code of conduct for members of ICSI.

Dear Friend,

You can be a Member of ICSI.

However practicing two professions like CA, CWA, CS, Lower etc. at a time is not possible.

That means you can practice either as a Lower or CS.

My Advice:

As you already a practicing Advocate and you got qualified CS, now you can enhance your practicing areas to Corporate Laws, Labor Laws, Tax laws etc.

Hi priya,

You cannot practice as an advocate as well as company secretary in practice at the same time.

You have to choose either of the profession. I am of the opinion that   you should surrender your practice certificate to the bar before applying for the practice certificate of the institute.

One can be a member of the institute and still practice law as an advocate, but at the same time one should be employed in any company where he/she is the company secretary,  that would amount to professional misconduct.

I want to practise law alone. But i like to be a member in CS simultaneously without practising cs. Being a member will not harm I hope. I heard this from my other friends. Kindly correct me if I am wrong.

Yes you may opt for ICSI MEMBERSHIP being a practicing lawyer.

Yes that is permitted as per law. Being a member of the institute is not a bar, to take up any other profession.

What law prohibits is, the mischief of simultaneously practising two professions at the same  time.

I like to be a member ICSI so that I can get more knowledge about corporate law and will be utilizing the knowledge as an Advocate more specifically as a Corporate Advocate alone.
