WHETHER FORM DIR 11 REQUIRED FOR REMOVAL OF DIRECTOR

I would like to know whether the filing of Form DIR 11 is required in case of removal of Director or just the filing of Form DIR 12 is sufficient.

Please refer section 168 applicable for resignation of director, needs to submit resignation letter with roc also.

Section 169 applicable for removal of director

But usually a Director is removed due to some mis-conduct or some dispute. in such a case will the director who is being removed file a return with the ROC. 

Moreover, like Bindu Madhava K G has pointed, Section 168 only says that a director should submit a copy of resignation letter with ROC. If does not talk anything about removal of director. In case of removal, the director being removed does not submit any resignation letter. In such a case is it mandatory to file DIR 11

please refer DIR 11 HELP form and section 168 along with Rule 16 of Companies (appointment and qualification of director Rule).

you will get all the clarity about DIR -11

I think if dir11 is not filed by director he will be liable for penalty. Pratically in big companies cs will follow the matter and comply with form dir11.

the rules are applicable only from 1st april, 2014
so, if event date is before that date, then no need of dir11
