Hello ,

What is the due date to file company returns? What forms are applicable?

Are section 8 Companies liable for audit?

Also if there is any LLP which has loss during the year in this case is Audit mandatory?

Dear Megha Ji,

following is the point wise answer of your questions:

1. Due Date of the Company Forms:
Ans: MCA has recently extended the due date of the forms i.e. AOC-4, MGT-7 upto 31st December 2025 without additional Fees. 

2. Are section 8 Companies liable for audit?

Ans: Yes, Every company registered under the Companies Act — including Section 8 Companies — is required to get its accounts audited under Section 139 of the Companies Act, 2013.

3.  Audit Requirement in Case of LLP (Loss Case)

Ans: Under the LLP Act, 2008, audit is not mandatory in all cases — it depends on turnover and capital contribution, not on profit or loss.

         As per Rule 24 of the LLP Rules, 2009:

Audit is mandatory only if either of the following conditions are satisfied:

• Turnover exceeds ₹40 lakh in the financial year; or

• Capital contribution exceeds ₹25 lakh.
