Auditor appointed to fill casual vacancy- New ADT-1

Hi

I want to file ADT-1 for appointment of auditor to fill casual vacancy. In the new form ADT-1, point No.7(b), it asks for the SRN of relevant form if auditor is appointed to fill casual vacancy. Which is the relevant form asked here for??? Appointment of auditor to fill casual vacancy requires either a Board resolution/ordinary resolution, for which MGT14 is not filed.

Does it refer to SRN of Form ADT-3 to be filed for auditor resignation? Please give your views on the same.

Dear Member,

1. In case of casual vacancy created because of Resignation by existing auditor, you need to mention SRN of ADT-3 which is to be filed by the auditor who has resigned. 

or 

2. In case of casual vacancy created because of Removal of existing auditor, you need to mention SRN of ADT-2 which is to be filed by the Company for taking prior approval of Central Government for such removal .

If there is any vacancy due to death of auditor or change in the status of auditor as a individual then its not fall under the category of resignation and removal of auditor then which form is relevant fro the same?

There is a casual vacancy of auditor due to dissolution of proprietorship firm of auditor. The existing auditor has dissolved his proprietorship business and joined as a partner is his father's partnership firm/

In this case, form adt1 will be filed to appoint the partnership firm as auditor to fill casual vacancy. But there is no need to file adt3. Please correct, if I'm wrong

Hi,

I want to file Eform ADT1 for appointment of auditor to fill casual vacancy. The casual vacancy is caused as the previous auditor has dissolved his proprietorship firm and joined as a partner in partnership firm. Point 7(a) asks if the auditor is appointed to fill casual vacancy and on selecting 'yes', it asks for SRN of relevant form, i.e., form ADT3. 

Form ADT3 is not filed as it is not a case of casual vacancy due to resignation. On entering Z99999999, it says "invalid SRN entered in 7(b) in the form)"

Kindly look into this case and share your views on how to resolve this issue

raise ticket ..you will get proper solution...but in my opinion before dissolution of partnership, your auditor needs to send resignation to your company. pls confirm with others.
