Admissibility of unregistered rent agreement of immovable property

dear members,

Please suggest whether the unregistered rent agreement (bot registered
in Court (executed on non judicial stamp paper) with lock in period of
three year can be admissible in the Court in case of earlier
termination of the agreement. As sec 17 of the Registration Act 1908
provides for compulsorily regfistration of rent agreement. Pls laso
refer proviso to sec 49.

 A lease agreement for one year or more is essentially required to be registered lest it is just a piece of paper having no evidentiary value in the eye of law. Therefore, you can terminate the agreement before completion of three years by just giving a notice.. In case of unregistered documents the contentions of tenant prevails over the landlord. Unregistered document is not admissible as evidence in court.

thanks for the reply sir. But the agreement is not a lease agreement,
it is a rent agreement for taking on rent an office and there is a
lock in period of three years in the agreement. So whether the
provisions as regards registration of lease agreement also applicable
in case of rent agreement. Pls suggest.
