What Next if - Fails to Create Charge filing under CHG1 within 120 days

Dear members

while referring provision for creation of charge it  is stated that we have 120 days overall for filing CHG 1.

In case entity fails to do that then what next  to do?

Enabling provision for Filing Application under 460 for condonation of delay but referring section 87 such aaplication for condonation repealed.

Kindly guide us what to do.
