Fwd: resignation of auditors from the company - ADT-3

Dear All,

I have a query  w.r.t. the resignation of auditors from the company

In one of my client company the auditors resigned as on 16/08/2014 and file heir resignation letter with the company but they didnt file ADT-3 with ROC within 30 days of the resignation.

further the company has appointed another auditors as on 21/08/2014 by giving the shorter notice to the shareholders of the company and filed GNL-2 with ROC

and the company has aslo done its annual filing in which it has given the details of new auditors only.

Now the old auditor is filing ADT-3 with the ROC but there is a prescuitiny error at the timie of uploading the form is coming out that the "Auditor is not associated with the Company"

now plz advice how can the auditors intimate the ROC about their resignation as ADT -3 can not be filed as the details of only new auditors has been given by the company in Form 23AC.

so plz suggest accordingly.

Dear Deepika & Jaya 

Please read the text of the Section 140 of CA, 2013; 

(2) The auditor who has resigned from the company shall file within a period of thirty days from the date of resignation, a statement in the prescribed form with the company and the Registrar, and in case of companies referred to in sub-section (5) of section 139, the auditor shall also file such statement with the Comptroller and Auditor-General of India, indicating the reasons and other facts as may be relevant with regard to his

resignation.

(3) If the auditor does not comply with sub-section (2), he or it shall be punishable with fine which shall not be less than fifty thousand rupees but which may extend to five lakh rupees.

Please take actions only after taking the expert opinion this is a new responsibility imposed on Auditor.

Dear Deepika,

I have faced such problem because GNL-2 you must have filed for Auditor that is why Auditors details is not fetching in ADT-3

You have to mail the Error and Form of GNL-2 along with Challan. They will fetch your data in ADT-3 and your problem will be solved.
