Query - INC 28 - condonation of delay for filing satisfaction of charge

Dear Members

We received the order from RD for condonation of delay in filing satisfaction of charge last week. Pursuant to same, we have filed INC 28 -attaching the order of the RD.

Today, we have received the approval mail from ROC for the INC 28 filed. However we have not received the charge registration certificate and the charge continues to reflect in the index of charges.

Is there any filing to be done after approval of INC 28? Kindly advise.

Unless you file form CHG-4 for satisfaction of charge, charge will continue to reflect in the index of charges on MCA site.

Dear Ankush

We filed CHG 4 first pursuant to which we had received intimation vide the challan that condonation had to be filed.

Subsequently, we filed for condonation and received the order and then filed INC 28.

Do we have to file CHG 4 again?

I think you must have received the intimation that the Form CHG 4 is to be resubmitted. Kindly do so, if u have received the same.

Even I have faced the same issue.  Pl raise query and speak with the concerned officer. They will approve the form

Dear Vivek

The delay in our case was around 40 days. Since the authorised capital was high, the filing fees for GNL 1 and CHG 8 itself was Rs.10,000 each.

Thankfully, the order was issued without any hearing and without a penalty besides the above-mentioned fees.

I have filed CHG-8 for condonation of delay and it is showing in the transaction status that the order has been issued. Can you please guide me how to obtain the order copy from RD in order to file the same with ROC in INC-28?
