absconding director

Dear Members,

I have a query, in a private limited company if any director are absconding/non traceable from last 10years, and company did not file any documents with ROC, but now we want to update all the filing so in this scenario how can we resign/remove these directors ?? as we cant apply his DIN.. what is the solution of this technical problem ?

Dear Sir

 

This is arjun currently pursuing ACS Executive Programme, i am working in one PCS firm, we had same problem in one of our client company.

 

you can resign or remove any director by putting prior 31st october 2006 date.

 

For this you need not want Din no. Only thing is you should bare 10 times penalty.

 

Please refer Form 32 3rd page.

plez click on YES on point no. 8 of form-32 then a new point will insert and u can fil the details of directors

Before doing anything like putting the older date of 5 years or something, make sure to check your annual filing of Annual Return of previous years. As in all those years the director would have been shown as continuing atleast till last annual return.

So please recheck.
