Prescrutiny Error in Form Dir-12

Hi,

We are trying to file Form DIR-12 for reappointment of wholetime Director in Private Limited Company while doing prescrutiny we are receiving an error that Date of Appointment of the signatory(s)shall be equal to or greater than the date of cessation. Kindly enter valid date. Person is already appointed in the Company under the same designation. Directors earlier appointment date was 06.06.2016 and 5 years expires on 05.06.2021 and we are showing their reappointment on 06.06.2021 then why this error. Please help us  what is the issue.

You can try mentioning date of reappointment as on 05.06.2021 itself.

the error is saying date shall be equal to or greater than the date of cessation  so reappointment date 06.06.2021 is also valid as per error

I think you are getting this error because you are filing form for appointment when his name is still reflected as Director on the website of MCA. In my opinion, you will have to file 2 separate forms - first for cessation and then for appointment.

Yes, it will show error,

There is only 2 option 

1. File 2 different form

2. File mgt-14 for resolution only no dir-12. Which is also valied.

Hi,

But as per section 117 (3) (c) Form MGT-14 is required to be filed only for appointment of MD. For WTD section 117 (3) (c) or section 117 does'nt say anything. So For WTD appointment only Form DIR-12 is there.
