Application to C.G_Form CHG 8

Dear Members,
For extension of time for filing particulars of charges after 300 days,we need to file CHG 8 as per the companies act,2013.
The e - form, CHG 8 is still not available. Let me know if there is any alternative way to file it.Can the documents be attached to some other form and filed??
Please share your views.

yes. RD-1 is the form to which you have to attach CHG-8 and other documents

Dear Friends,
In this matter, there are lot of ambiguities.
The MCA circular prescribes Form RD 1 for attaching filled in Form CHG 8.
However, if you go through Form RD 2 available on MCA portal, it is made ONLY for Sec. 87(1) and requires mandatory attachment of CHG 8. It is also insists for attachment of Petition. However, unlike in the earlier rules, no format is prescribed.

For condonation of delay, now no need to file any petition and just apply to CG in prescribed form CH 8.

Dear Pracheta,
Have you filed RD 1 for condonation of delay.
As mentioned above by Mr.Tripathi, form RD 2 looks specific for this purpose.
The purpose of application in RD 2 is already marked i.e, app. u/s 87(Rectification by C.G in Register of Charges). It also asks for SRN of CHG 1/9/4 and details of Charge holder.

No. I had prepared all the details but did not file due to some reasons. I have not checked RD-2.

I think RD-2 is to be filed for condonation of delay.
In which form will it be filed for intimation to ROC?
When I filed GNL-1, I got a fee of Rs.10,000.............so opted out to file it in GNL-2.

As per general circular no 6/2014 dated March 28,2014 ,RD 2 (earlier 24 AAA)is the form for filing petitions to C.G(R.D)for condonation of delay u/s 87 of Companies act,2013 (141 - corresponding sec of CA,1956).

Mr.Ganatra,
The order of C.G(R.D),needs to be filed to ROC in Form INC - 28.
Its mentioned in the instruction kit of CHG - 1 as well as INC 28

Yes, but which form shall be filed instead of Form 61, if no form to be filed, then how will we intimate the ROC?

I have filed RD 2 for condonation of delay in filing earlier Form 17 i.e,Satisfaction of Charge.And with it, attached all the documents which was required as per CA,1956.
