Factory Manager under Factories Act, 1948

Dear Members,
 
Is there any qualification or disqualification for Factory Manager under Factories Act, 1948?
 
Basically the question is about whether a person on whom there is any court case pending or who is on bail, be appointed as factory manager or not ??

As per the Factories Act, Manager is defined u/s 2 :

(l)        “manager” means the person responsible to the occupier for the working of the factory for the purpose  of the Act.

There is no qualification prescribed / defined as such under the Factories Act for "Manager". He is appointed by the Occupier.

Normally, a Manager is an employee of the establishment, and if stated under the company;s certified standing orders, an employee against whom a court case is pending shall not be appointed by the company / establishment as "Manager".

You mean to say if standing orders are silent on this issue, there is no problem in appointing any person as a factory manager, irrespective of his background.
