Addition of Trustees !!

Dear Friends,

I want to add more trustees to a trust whose deed is already registered. How should I proceed, will this amendment be on plain paper or Stamp Paper..? will this also get regsitered?

Hi,

Check the trust deed as to whether it permits amendment or not. If permissible then amendment has be made on stamp paper and registered at the sub-registrar office. Also check whether its an irrevocable trust or not and see have they applied for 12A / 80G certificate. If taken then prior permission is necessary for amendment.

Thanks Pawan, The Trust deed permits amendment but nothing in deed states whether it is irrevocable or not. Also the trust is registered few days back so it hasn't applied with IT Dept. Yet.
Do minutes of the trustees will also be required to be registered...what shall be the value of stamp paper?

Hi,

Stamp duty differs from state to state. Its better to contact an Advocate or an agent near subregistrar office. I dont think so the stamp duty will be very high.

please register amendment deed as a miscellaneous document for purpose of stamp duty. It will be nominal. Per chart/schedule/State.
