LLP for Manufacturing

Dear Professional, 

Recently I came to know from somewhere that LLP can not do Manufacturing business from now. 

I tried finding the notification in this regard but did not get it. 

Is this is true or it was any rumor?

True, ICSI has made representation to MCA. It is understood that existing LLP into manufacturing are exempted. But new LLP are facing this issue.

Soon this will get resorted.

Happy to inform that on the representation of ICSI, MCA has agreed to take the liberal view and has started allowing Manufacturing activities for incorporation of new LLP and for conversions of Companies into LLP.

There's no such confirmation from MCA regarding this that based on recommendations from ICSI, MCA has agreed to do so. Today also in newspaper it has come that "Governments have barred LLP's from entering into manufacturing activities".

So let's wait for further clarifications from MCA regarding this matter rather jumping the gun by these rumours spread in social media.

If LLP if banned doing manufacturing activities, it is " Harassing of doing business"

It will be restriction on constitutional  right of doing lawful business.

Please recollect, Indian Partnership Act, 1932 do not  contain such restriction.

It is citizen's own prudence that in which legal form , he can carryout his lawful business.

MAY THE GOD GIVE GOOD INTELLECT TO MCA

Government can't do such an order which can affect your lawful right conferred upon you under valid law.

One must challenge such direction of Govt. before Constitutional Court i.e. High Court of Supreme Court.

Manufacturing & allied activities were restricted in LLPs vide OM No. CRC/LLP/e-Forms dated 06.03.2019. This OM invoking the restriction regarding manufacturing & allied activities has been withdrawn with immediate effect
