NOW , FORM ACTIVE (INC -22 A) CANNOT BE FILED WHICH IS MANDATORY FOR EACH & EVERY COMPANY IF IT DOES NOT SATISFY THE FOLLOWING CONDITIONS.

Dear All,

Now, the question is Form INC-22A ( as per help kit) will pre-fill all the relevant data,

However the company will not be able to file the Form ACTIVE status, in following cases:

Form ACTIVE status .... (A)

1. Directors - In case DIR 3-KYC is remaining of any one Director

2. Statutory Auditor appointed and form not filed

3. Cost Auditor appointed / not appointed and form not filed

4. Company secretary as required by the Act if compliance done or not done and form not filed.

5.Annual accounts for F.Y 2018 if not filed.

The Company not filing INC 22 A and marked as ACTIVE non-compliant......... (B);

1. will not be able to make changes to its capital structure or go ahead with merger or amalgamation

2. increase its paid up capital or

3. appoint directors except cessation or

4. change its registered office address or

5. do merger or amalgamation

Now, the question is what if the company do not intend to do any of the activity as listed in ACTIVE non-complaint .... (B) above;

and thereby avoid filing or keep pending of filing of the file Form INC 22 A for non-compliance of any of the activity as listed in filing ACTIVE status ....(A) as the company will be able to file its Annual returns or charge or any other activity other than listed in (A) above and will remain in ACTIVE non-compliant status and might do it later on filing penalty of Rs.10,000/-

Dear All,

I am trying to fill Form INC 22 A but Name and Registered Office Address in Field no. 1 is not getting pre-fill. Field No 8 for Annual Filing 2018 is also not getting pre-fill. I have filed Annual Return and Balance sheet within time limit. Form is showing Zero in the field 2 which is no. of Directors. I am filing for Pvt Ltd Company. We have appointed Statutory Auditor for 5 years from 2014 to 2019. Form is prefilling Statutory Auditor also zero.

Is there any Technical Problem with the said E Form?

Does any one successful in filing data in E Form INC-22 A ACTIVE? I think there is some technical error due to which fields are not getting pre-filled.
