Dear All,

Pls clarify whether Affidavit is mandatory for taking DIN of foreign national person. If yes,  where notarise or what is procedure.

If this person is in India , than is allowed to notarise in India or should require to be done in their country only.

I spoke same matter with DIN authority on phone, they replied it should be done in the respective country not in India or any other country. Is as per new guideline and which will be published shortly on site.

Its harsh procedure, if same person is in India and again require from their own country.

Pls lighten on this matter , any other views.

Dear Mr Amrut,

Yes Affidavit is mandatory.

Regarding documents for applying DIN:

  • Proof of Identity-  Self attested &
  • Proof of Residence - Self attested
  • Affidavit as required

In case of director, the supporting documents can also be attested by Company secretary in full time employment / CEO / Managing director of the Indian company in which he / she proposed to be a director. n case the director is residing outside India, then the attached supporting documents should be attested by the Consulate of the Indian Embassy, Foreign public notary.

If the supporting documents are in the language other than English than the same needs to be translated to English language and attested by the Consulate of the Indian Embassy/ Foreign public notary.

Members please correct me If I am wrong.

Dear mam,

Affidavit is ok. But if the same person is in India than also it required to be attested by the Consulate of the Indian Embassy, Foreign public notary. Why is not done in India just we have do for other case.

Or the same affidavit is attested by the consulate of the respective country in India.

If he /she is India and only for Affidavit he/she required to go in the respective country and make affidavit. It is not harsh to the same person. Same is tell by the DIN authority as per new guideline.

Psl express your views.

thanks

If the foreigner is at present in India, copy of his/her valid visa will serve the purpose along with other documents.  Then the notarization  can be done in India.
