La Ley 3/2013, de 4 de junio, de creacin de la Comisin Nacional de los Mercados y la Competencia, en su redaccin dada por el Real Decreto-ley 1/2019, de 11 de enero, de medidas urgentes para adecuar las competencias de la Comisin Nacional de los Mercados y la Competencia a las exigencias derivadas del derecho comunitario en relacin a las Directivas 2009/72/CE y 2009/73/CE del Parlamento europeo y del Consejo, de 13 de julio de 2009, sobre normas comunes para el mercado interior de la electricidad y del gas natural, establece en su artculo 7.1.g) y h) que es funcin de la Comisin Nacional de los Mercados y la Competencia establecer, mediante circulares, la tasa de retribucin financiera de las instalaciones con derecho a retribucin a cargo del sistema elctrico de las empresas de transporte y distribucin para cada periodo regulatorio, as como la tasa de retribucin financiera de los activos de transporte, distribucin y plantas de gas natural licuado con derecho a retribucin a cargo del sistema gasista, para cada periodo regulatorio.
Segn lo establecido en el artculo 7.1 de la Ley 3/2013, de 4 de junio, la tasa de retribucin con cargo al sistema elctrico y gasista no podr exceder de lo que resulte de conformidad con lo establecido en la Ley 24/2013, de 26 de diciembre, del Sector Elctrico, y la Ley 18/2014, de 15 de octubre, de aprobacin de medidas urgentes para el crecimiento, la competitividad y la eficiencia, respectivamente, y dems normativa de aplicacin.
Excepcionalmente, los referidos valores podrn superarse por la Comisin Nacional de los Mercados y la Competencia de forma motivada y previo informe del Ministerio para la Transicin Ecolgica, en casos debidamente justificados. En este caso, la Comisin har constar el impacto de su propuesta en trminos de costes para el sistema respecto del que se derivara de aplicar el valor anteriormente resultante.
En lo relativo al sector elctrico, la Ley 24/2013, de 26 de diciembre, dispone, en su artculo 14, que la retribucin de las actividades se establecer con criterios objetivos, transparentes y no discriminatorios, que incentiven la mejora de la eficacia de la gestin, la eficiencia econmica y tcnica de dichas actividades y la calidad del suministro elctrico.
Para el clculo de la retribucin de las actividades de transporte, distribucin, gestin tcnica y econmica del sistema, y produccin en los sistemas elctricos de los territorios no peninsulares con rgimen retributivo adicional, se considerarn los costes necesarios para realizar la actividad por una empresa eficiente y bien gestionada, mediante la aplicacin de criterios homogneos en todo el territorio espaol, sin perjuicio de las especificidades previstas para los territorios no peninsulares. Estos regmenes econmicos permitirn la obtencin de una retribucin adecuada a la de una actividad de bajo riesgo.
Los parmetros de retribucin de las actividades de transporte y distribucin se fijarn teniendo en cuenta la situacin cclica de la economa, de la demanda elctrica y la rentabilidad adecuada para estas actividades por periodos regulatorios que tendrn una vigencia de seis aos, salvo que una norma de derecho comunitario europeo establezca una vigencia del periodo regulatorio distinta.
Estos parmetros retributivos podrn revisarse antes del comienzo del periodo regulatorio. Si no se llevara a cabo esta revisin se entendern prorrogados para todo el periodo regulatorio siguiente.
Para las actividades de transporte y distribucin las tasas de retribucin financiera aplicables sern fijadas, para cada periodo regulatorio, por la Comisin Nacional de los Mercados y la Competencia.
No obstante lo anterior, para cada periodo regulatorio se establecer por ley el lmite mximo de las tasas de retribucin financiera aplicables a las actividades de transporte y distribucin. Este lmite mximo estar referenciado al rendimiento de las Obligaciones del Estado a 10 aos en el mercado secundario entre titulares de cuentas no segregados de los veinticuatro meses previos al mes de mayo del ao anterior al inicio del nuevo periodo regulatorio incrementado con un diferencial adecuado que se determinar para cada periodo regulatorio. Si al comienzo de un periodo regulatorio no se llevase a cabo la determinacin del lmite mximo, se entender prorrogado el lmite mximo fijado para el periodo regulatorio anterior. Si este ltimo no existiera, el lmite mximo para el nuevo periodo tomar el valor de la tasa de retribucin financiera del periodo anterior.
