See below about licensing for the Chile imagery we are currently making available, including the RapidEye in this KML:

Thanks,

Bonjour Nicolas,

All the imagery that we are currently purchasing from DG and GeoEye
falls under our current commercial licensing agreement that we have in
place. Currently, no restrictions to the licensed content have been
lifted due to the tragedy, as they were for Haiti. But if that
situation changes we will make sure to let you know.

Thanks,
France

In the past (Haiti crisis) OpenStreetMap got the permission to trace data from the imagery and make the data available under CC-BY-SA (commercial use allowed). Note that OSM doesn't want to license the imagery under CC-BY-SA, but the data traced from it.

That means this statement http://www.google.com/permissions/geoguidelines.html applies?

Tracing. You may not use Google Maps or Google Earth as the basis for tracing your own maps or other geographic content.

so: OSM cannot use the imagery to trace objects in Chile?

Marten,

This is indeed my understanding of your quote, and of France's...

What is Google's motto, again ?

Cheers,

Jean-Guilhem

Sorry Christiaan,

Nothing personal here.

I have no doubt that you guys are doing your best. (And I do appreciate
it all day long).

This was my modest, maybe awkward way to encourage opening, by voicing
what the reaction of M. everybody could be.

I have no precise knowledge of advertising, but my guess is that a
dollar invested in this kind of effort is worth more than one dollar
invested in "traditional advertising".

(not copying your private mail here. This is my 0.02 cent idea on how to
encourage data providers to open up their license terms, by gaining free
"media space").

Sincerely yours,

Jean-Guilhem
