Challenging the Washington Department of Ecology
Today, Yakama Nation, represented by their Office of Legal Council and Columbia Riverkeeper, represented by the Western Environmental Law Center, are at the Washington Court of Appeals, challenging the development’s water quality certification. Ecology issued the permit in 2023, and it has been under litigation ever since. Oral arguments are underway for why the court should remand the permit back to Ecology to account for impacts to groundwater and the Columbia River.

Request for Rehearing
Last month, the Federal Energy Regulatory Commission (FERC) issued a hydroelectric license for the development. On Monday, both Yakama Nation and Columbia Riverkeeper filed requests for rehearing with FERC. Both requests detail how FERC violated the National Historic Preservation Act, National Environmental Protection Act and the Administrative Procedure Act in issuing the license. After FERC rules on that petition an appeal can be filed in court.
