Legal immunity of recreational pilots

This is an update of the status of some bills that are impacting our ability to be able to use private land and the immunity from lawsuits that they have:

  • A bill introduced to the Oregon House would have allowed recreational businesses to require customers to sign a release for claims of “ordinary negligence,” making it harder for customers to sue. That bill is dead. 
  • A bill that provides recreational immunity should pass.  You may recall that many cities have closed some trails after a woman sued the City of Newport when she slipped and broke her leg while walking on a wet bridge.  The City would have been immune under previous recreational immunity laws, but she claimed she was not actually recreating - she was ~on her way~ to the beach to recreate.  The bill should make it clear that trail owners are immune from lawsuits if they let the public use their property to recreate or to access recreational pursuits.
