Attached is the Zoning Variance Application for Case # 56-2024 (1074 North Harrison Street) to be heard on Tuesday, October 14, 2025, at 9:00 AM. 

 

The hearing will be semi-virtual. Board members, City Staff, Applicants, and members of the public may either attend virtually through zoom or in person in the hearing room at 201 West Colfax Avenue, Denver, Room 2.H.2.

 

Please be advised that we have recently adopted new Rules of Procedure which require submittal of all materials farther ahead of the hearing.  Submittal deadlines for all parties are listed on the application and have been explained to the Applicants.  Members of the public may submit exhibits or documentary evidence no later than the Thursday prior to the hearing.  The full set of exhibits will be finalized and available to all interested parties the Friday prior to the hearing. 

 

Exhibits submitted after the deadlines may not be included in the file for the Board to review.  Anyone who has not met the deadline to submit documentary evidence for the Board to review may attend the hearing to provide verbal testimony for up to 2 minutes.

 

Virtual attendance will be held through Zoom.  If you are not familiar or need help to ensure your comfort level with using Zoom, please let us know and we will work with you to ensure you can participate.

Would you please forward CPN the Applicant's Site Plan showing the proposed fence(s) exact locations  and heights relative to the adjacent Sidewalk along 11th Avenue and Alley to the East of the Site? 
It would also be quite helpful to see their elevation drawing(s) of the fence(s) with materials / specifications indicated.

Hi Bryan,

Thanks for raising your concern. Our retaining wall is properly permitted, and per the request of the city, set back from the sidewalk so that the city can easily make sidewalk repairs without issue; this is in contrast to the property used for short term rentals behind our home that was not permitted and not set back. 

We heard that the city was going to require the property to replace the wall within a year but that has not occurred, and their wall also is falling down on the corner closest to our house often impeding the sidewalk. 

We generally agree with you that this is a concern in our neighborhood that should be addressed.

Yeah, I do see the permit record, but as far as I can tell, Zoning Permit 2023-ZONE-0000884 indicates that the wall was to be installed "Inside Setback."

Do you know where your property line is located & is the wall installed inside the setback?

I just ask that this taller fence is installed on Private Property.
