Raised Encroachment in Public Right-of-Way

Hello,

Please see the raised planter installed in front of the All Inn Motel project at 3015 E Colfax Ave.

It is my understanding that raised encroachments in the public right away are not to prohibit water from flowing into and through the public right of way.

I'm referring to the city of Denver's rules and regulations. 

Encroachments in the Public Right-of-Way
Reference Number: DOTIRR-025.4

Specifically:
19. Encroachments shall not obstruct stormwater drainage in and through the ROW nor cause water to collect on Sidewalks, streets or alleys or conflict with DRMC Section 49-554.

Request for that entire raised curb to be removed from along the sidewalk & reinstalled flush with the sidewalk like the section adjacent to it that I marked in green in the photo. 




I also feel that even if there were gaps installed in this raised planter that it should at minimum be 6 in away from the sidewalk to help avoid a pedal strike hazard to align with Denver moves, pedestrians and trails. 
All the examples beginning at page 14, to have flush surfaces adjacent to one another. 

In addition to addressing this specific issue, I would like to know who can help prevent this from happening going forward.
