Permission for video

We're getting ready to do a video of Business Success Unlimited, it's rooms and participants in meetings, and members. My sister, who's a professional photographer tells me I have to have a release form in order to photograph or videotape these individuals -- getting them to say it's okay for me to use their images. My question, have any of you, when you've made a video, had your "stars" sign release forms or is it just understood? I want to put this video up on the website, on YouTube, and various media. I want to protect myself, BSU and those who are being taped. Thoughts?

When Workantile's previous owner did a video he got releases.

I am involved heavily in various information security conferences.  Derbycon BsidesLV,BsidesDE, Shmoocon, etc.  Our speakers are informed, as part of the speakers information sheet, that they will be video'ed, and given a free copy of their video.  Their slides are required to be submitted, so they can be distributed to attendees, etc.  If you choose not to be video'ed, at some conferences that is a valid choice, and the cameras go off, and the audience is informed that they are special, cause no one else gets to see it.  Sometimes adds a little cachet to a topic. 

And protects some people who aren't allowed to present, to do so safely.

Speakers information sheet/email = the thing they get saying, you are speaking on Saturday, at 10am, in this room, and you should pick you your badge at x place, at y time, and we're looking forward to seeing you there!  Etc etc etc.

We always get a release form from participants in our videos. By this
I mean anyone who speaks or is featured in any way. We don't get
releases from people who are randomly in the background.

We do this as more as a courtesy than for legal reasons. But having
said that, our lawyer likes that we do it.

Reminds me.  Due to privacy concerns, we only allow video recording from the back of the room, so only the backs of peoples heads are visible.  Anybody sensitive to it, sits on the sides.  Of course, this is for InfoSec cons, where feds and black hats mingle freely.  So privacy is sometimes not just a preference, but a legal necessity.  :)  YMMV.

The official word is yes, you need permission for anyone whose face and every artwork you can see. Also, any voices that you can hear. It doesn't matter if these people/artwork are professional actors/artists or whatever.

HOWEVER, if you're vids are not being used in a commercial, $-generating way, then the need to gain permission isn't as critical; otherwise, YouTube would have their hands full for every casual vid they broadcast.

Thanks, all for the answers. Now, the next question.... anyone have a form they'd be willing to share? I have the one my sister uses but it is for photgraphic images that she turns into portraits, and for saleable items.

It's been said, but to reiterate the point, you will need a release
for, at the least, anyone that is "featured" in the video. For
instance, you are taping an "interview" with one person as the subject
and one personal asking the questions. The "interviewee" as well as
the "interviewer" need to have signed a release that states what the
terms are: media used, rights of the publisher/videographer/actors
(voice or otherwise). If this is being taped in a public space, i.e. a
street side cafe, then you will not need releases for anyone that
happens into the frame. If, on the other hand, the background actors
are being paid or compensated in any way, I would get a release from
them as well.

This, of course, can vary wildly from locale to locale. What I would
caution you to do is get in touch with a professional group that can
recommend a lawyer that is current in these topics in your specific
location. PPA (Professional Photographers of America) is a good
resource and has lots of information on there website as far as
releases and copyright go. They also have a list of lawyers that would
be able to help.

As a professional photographer myself, I ALWAYS get a signed release
before I shoot any assignment, still or video, from any of the
principal subjects.
