It looks like the issue of not allowing our HOA members use of the Community Room has become a major issue with our members and they are chewing my ear off complaining and demanding that we take legal action. All our homeowners are complaining that when they were in the process of buying their town home(s) at Corde Terra Villas they were told by the sales people of Roem that upon purchase of their town house they would have full use of the swimming pool, exercise and computer room and the community room. They were told that they could use the community room for birthday parties and other special occasions without charge. When I bought my unit I was told the same thing. Mahesh just told me that you denied him the use of the community room for his son's birthday party. Kevin Shinmoto, one of our HOA Board members, tells me that you also denied him the use use of the community room several months ago. Our home owners now are demanding that we file suit against Roem for breach of promise, false promise and bad faith sales/business practices. This is not the first instance involving Roem's bad faith business actions involving our home owners as another previous incident involving the units lower crawl/storage spaces has generated ill will toward Roem. There is no question that as the manager of the affordable housing complex (The Village), Roem has the authority to direct you to honor the commitment made by Roem.
I suggest that you confer with Roem as quickly as you can so we can resolve this issue. I have already instructed our HOA lawyer to file legal action. I believe the papers will be prepared in a few days.
