Hi ,
I have a situation wherein my home loan financing company has changed
the originally agreed terms and conditions. Can this be challenged
given the fact that every agreement has a clause like "The bank can
change the terms and conditions at its sole discretion" .
Thanks,
Nitin

Yes, it can be challenged. No agreement can be one sided and the consumer has to be given an opportunity to be heard. Ofcourse, such challenges have a long route in the court of law. You should immediately give it a try my sending a communication to the Executive Head of the Bank that their action is unfair and not in the interest of the consumer. I am these days in Ottawa attending the meeting on Codex Committee on Food Labelling (CCFL) as a member of the Indian Country delegation. This Committee is mandated to harmonise all the food safety laws concerning labelling globally. Codex is a WHO/FAO joint initiative. Read more about this www.consumer-voice.org

Yes,

I agree
Such a clause is violative of the principles of natural justice, You
can actually file a writ petition with the High Court under Article 226
of the Constitution
