Peruvian Contact and Question

Hi Art and Michael,

I wanted to forward to you a very interesting question that just arose with a new contact of mine in Peru, and would love to hear your thoughts.

Google Translate can translate the following message reasonably well, but here's a little summary of the situation:

Fernando (with SADE Group), is working with a ginger business who plans to export to the US. He reached out to my friend from Friedman, Catherine, asking her to register as their US agent. (Foreign processing facilities must register with the FDA, and they must identify a US agent to essentially serve as the US contact of the foreign facility for the FDA should an issue arise.) 

I told Catherine that she should definitely not be the US agent because she doesn't have any relationship with  the Peruvian ginger business. Instead, the Peruvian business should identify a US importer, distributor, or retailer (essentially someone or some business with whom they work directly) to serve as their US agent. (Catherine is a friend of Fernando's and that's the only reason why he asked her to be the US agent. They have no business relationship.)

And here are my questions for you guys (for Art in particular):

• Did I respond to Catherine correctly by saying it doesn't make any sense for her to be the agent?
• Is it true that the Peruvian ginger business should do their due diligence to identify a US agent with whom they work directly, for example an importer, distributor, or retailer? 
• Also, serving a a US agent is not a "big ask" because it doesn't involve assuming legal responsibility for the product, but rather only serving as an informational contact...right?
• Lastly, Fernando says that they're planning a shipment for this coming Thursday :P My larger, more esoteric question is this: Can foreign companies export to the US and conduct business without following the FDA regulations? Can they carry out the shipment on Thursday without previously identifying a US agent?

It's likely that Fernando will bring this question (i.e. "How to identify a US agent for a foreign facility") to me directly because he and I have previously connected about Catalyze Ventures' services and you can see he mentions me in his email to Catherine. I'll of course loop you both in again if he does end up reaching out to me with this, or other, questions

Estoy seguro que Sarah sabe de estos tramites y requisitos, yo recién voy a responderle el correo para quedar con ella para conversar.

La FDA, solo necesita de datos para registrar al  Agente FDA, persona de contacto que resida en los EEUU y que tenga: Nombre y Apellidos, Dirección, Código Postal, E-mail, Telefono.

Mi pregunta es si nos puedes apoyar en este emprendimiento siendo nuestro agente FDA?, 

Para mayor información y para que tu puedas comprobar lo que te menciono en cuanto alcances de ser Agente FDA,  te envío la web page de la FDA donde habla del tema que fue proporcionado por el especialista del tema de Prom Peru, empresa especializada en Exportaciones del Peru. Querida Catherine,

Que bueno saber que estas mucho mejor de salud y estas ya en el trabajo. Todavía no hemos podido conversar por skype, te propongo el día lunes, que te parece?…si puede ser en la tarde, mejor por acá, ya que la mañana ando a veces saliendo fuera de mi escritorio.

Catherine, me commentate que tienes una amiga que se  especializa en reglas y procedimientos de seguridad alimentaria y todo los procesos de introducción de alimentos frescos, verduras, a los USA y EU. Me encantaría conversar con ella, es posible que me contactes con ella?…podrías salir conclusiones interesantes de trabajar con Latinoamérica y ver como sumar esfuerzos y  claro Catherine, cuando regreses a este mundo, por supuesto que cuentas con nosotros . Que te parece?

Hi Sarah,

Sorry for the delay in getting back to you! I had a last minute flight for an interview with EDF in DC yesterday and am just now getting back to email.

I don't have any thing specific to advise on these issues, but I think your approach and erring on the side of conservatism, when it comes to not serving as an agent makes sense to me. I find it hard to imagine that the company would be able to have its good shipped if it didn't have an agent. Wouldn't it stuck in customs? But that's just conjecture, I bet Art has better insight.
