One of my client company has received a notice u/s 248(1)(c ) of the companies act, 2013 that the company is not carrying out any business or operations for a period of two immediately preceding financial years and has not made any application for a dormant company u/s 255. ROC has issued a show cause notice that the name of the company will be removed from the register if proper reason is not given along with requisite documents.
This is not a show cause notice for not filing annual returns/ financial statements, but for not doing any business for two immediately preceding financial years.
What reasons can be given in such a case. There are so many companies which have no turnover for years altogether. And what documents can be produced in such cases.
If anybody has experience in such matters, can they please share it.
