Giving/selling Win98 Beta

I have a two part question here. First, if someone gets Win98 Beta
(legally I mean) and they find they really don't want to put it on there
system, (ie. don't like it, doesn't run right on there computer, thought
it would work on a C-64....) can they give or sell the CD to someone
else?? And of course, the second part is that if any of the above is
possible, I would like that unwanted CD of Win98 Beta. If anyone knows
any of this for sure, please let me know.

He/She may NOT give/sell/rent/lent the CD to you as you have not signed
the Win98 NDA and he/she would be violating his/hers.

In the MS licence it says that the beta is provieded free and the owner
of the CD must not sell it but can put it on up to 10 computers that are
his.
