I haven't done any sums on this lot, but it would appear that the E.U. is
quite determined to stamp out anti-competitive behaviour!

Unfortunately, your link doesn't support your claim. I thought for sure
"[stamping] out anti-competitive behaviour" meant the EU Competition
Commission was going to disband itself and let market competition rule the
day.

But the content in your link does not say that :( It appears the EU is as
anti-MS and anti-competitive as ever.

'Fraid not, DFS. I realise that you like revising history to suit your
point of view, but the linked article merely demonstrates that the
European Competition Commissioner wants, as always, to stamp out
anti-competitive practices that harm the interests of European citizens
and businesses.

What Commissioner Neelie Kroes is doing is finding the most effective
way to ensure that law-breakers stop breaking the law. As Kroes says:

"Fines are one of the means to ensure that companies do not engage in
anticompetitive behaviour. To that end, fines must be set at a level
that ensures sufficient deterrence. This implies that fines should not
only punish past behaviour, but also that their level will deter that
particular company, or any other, from entering into illegal behaviour
in the future."

If they were dealing with an individual rather than a company,
imprisonment would also be one of the steps to consider. But it's
difficult to prove that one executive in particular is the responsible
party who should be sent down. Shame really, a stretch in jail might
help Gates with his humility problem. Still, the bottom line is the
spot that hurts a company the most. And a fine must be high, so it
substantially affects profits. This angers shareholders, and makes it
more likely they will discourage the company from messing with the law
again. Read the article again - Kroes goes on about how to discourage
criminal behaviour. Microsoft is a criminal organisation. Isn't that
what the USA has its RICO statutes for? To deal with organised crime?
Don Gates, LMAO!

I think the European Commission should just ban Microsoft from dealing
in Europe. That'd annoy some people in the short term, but they'd get
over it. And in the end they would be grateful that someone had made
them use a different OS - one that worked, one that didn't spend every
other minute trying to rip them off any way that came to mind.

How have they been harmed? Besides MS competitors (whiners), what EU

It's a sad joke. For more than a decade the EU countries purchased MS
software by the millions, thus helping to build and consolidate and maintain
MS' monopoly position. Now they turn around, and at the behest of some
large corporations, they try and make MS behave the way they - not the
marketplace - want.

The parties responsible for hugely successful businesses like MS should be
rewarded.

Why should he be humble? He's the most successful businessman in history.
His company dominates its industry. Some of his product lines have/had near
100% market shares. People love his software products. Businesses clamor
to get into partnership with MS. The Queen of England gives him honorary

China visits him before visiting the President of the US. He hosts annual
CEO Summits attended by the most powerful business leaders in the world.

What's to be humble about?

And what do you suppose a cola pipsqueak like yourself (or any of the

Banning MS (and Windows) in Europe would do far more than annoy people. It
would cause significant economic hardship for many millions. It would
devastate the education system. Infuriate the millions who play Windows
games. Shut down nearly all hardware OEMs. Close down nearly every
computer store.

In short, a catastrophe.

It would take years and many billions of additional funds to [attempt to]
replace Windows with Linux in the EU, and in th end it would be a gross
failure as millions of users come to realize there is no good alternative
for many Windows programs, soon after which Windows piracy rates would jump

corporations choose it for their desktops (and for a lot of server work).

personal offensiveness with me again, so I'll take some time and refute
your bullshit step by step.

For a start, anti-competitive behaviour is bound to harm competitors.
That's so obvious it /should/ be beyond stating. But you want to
ignore it. Surprise surprise. That's like saying: "Name one person
harmed by Jack the Ripper other than the prostitutes of London." As
for me demanding that I prove the European Competition Commission's
case - that's puerile. The Commission already did that. Whether it
was to your satisfaction or not is irrelevant. And anyway, you want
the nitty-gritty - read the ECC's papers. I don't work for the
Commission.

Then you ask me what laws have been broken. I don't know. IANAL. But
it stands to reason that Microsoft have broken European competition
laws, otherwise they wouldn't be punished for it. Unless you are
claiming that they're victims of a miscarriage of justice. Is that

businessman. I agree -phenomenally successful. If getting on well in
commerce and making shed-loads of money was a good way to measure
overall success, he's got it cracked. He's lacking in certain
character aspects however (I say that on the basis of the way I've seen
him speak in public, and on the way he has treated other members of his
profession). And anyway, /everyone/ needs humility. Whether you're
king of the world or a begger. No one is perfect, and acceptance of
that fact is humility. Unless you contend that Gates /is/ perfect?

supposed to do: beat the competition. That means Pepsi staging a blind

You're naive. They're being punished for being a huge, successful, dominant
American corporation in the EU's backyard. That's it. They already
more-than-complied with the EU's requests, but that was deemed not good
enough. You watch and mark my words - the EU won't be satisfied until MS
themselves is forced to actually write Windows-compatible server software
for the complainants.

I do like to watch boxing and the Ultimate Fight Championships from time to

Is that the best "advocacy" you can come up with? Even Rex Ballard can do
better than that.

MS isn't safe from Linux. Linux already has earned a good chunk of the
server business. The desktop is another matter altogether - there Linux
isn't a contender. I seriously doubt it ever will be.

The European commission found that Microsoft had used it's near monopoly
position to thwart competitors.

This meant that those competitors A) could not get a toehold in the
market or B) were put out of business. In either case, those
competitors products or services are not available to EU citizens and
companies thus harming those citizens or companies who would want to buy
those products or services.

Nearly all business may be anti-competitive, however 100% of business
must be carried out within the laws in force in the jurisdiction within
which the business operates.

Note that 100%? That means that _every_ company must obey the laws
wherever they do business, or face the consequences. Microsoft did not
obey the anti-competition law in the European Union, now they are being
punished.

Do me a favor, provide one link to a report where a court, any court has
found Microsoft not guilty of anti-competitive practices in the EU.

If you can't, then there's no point arguing with you, you counter facts

No. If anything, it would promote local development of software.

I can't for the life of me imagine why. For one, a ban on Microsoft
would be for sale of new products, so the next migration will just have
to be to something other than Microsoft products the next time.
Secondly, you seriously overestimate their importance in the educational
system. Linux is actually more suited for school deployment, as it's
cheaper and can easily be secured against kids with too much time,
trying to mess them up. Oh, and my University department runs on a
Solaris/Linux mainframe/terminal mix. Works just fine, and I haven't
had to worry about the instability of Windows for a long while.

By the time they need to upgrade their computers and OS, all games will
definitely be written for Linux as well (many are today, and most run
perfectly in Cedega). Or are you suggesting that the game manufacturers
will just ignore a market of some 450 million people in the EU? Don't

This one you'll have to explain. It makes no sense. Unless you mean
that less new hardware will be required because Linux extends the
lifetime of older hardware. In that case, you might have a point.
However, it is still better for the economy as a whole (think broken
window fallacy).

I'm not so up on the latest bands as I used to be, mainly because I seem
to have less time to listen to music these days. I tend to buy Rock Sound
or Metal Hammer when they have giveaway CDs (Rock Sound has one every
month), which is a way of hearing what's new out there, but I buy fewer
CDs than I used to, as well.

I like other stuff, too, mind you. The Jam, REM,some of the heavier
non-vocal dance. Not into soul, though. Too wishy-washy. I like guitars :-)

My wife loves it. I like country rock like Skynyrd and Charlie Daniels
Band, and some of the ballads, but the slide guitar just grates.
Unfortunately, it's in about 80% of country songs.

tunes. Otis Redding, Marvin Gaye, others from that time. I like Prince's
music from the late 80's and early 90's (his newer stuff isn't very good
compared).

till a workmate turned me onto Metallica and other similar stuff around
1990. My tastes developed from there, getting heavier and heavier.

Not the real hardcore stuff. I thought that, until I saw a documentary

documentary (Some Kind of Monster). Pretty interesting. I was never into

Ah, European Metal totally kicks ass! Timeless, powerful, totally breathaking
music. "Heartwork" by Carcass is among my all time favorites along with
Paradise's "Icon" and "Draconian Times". And don't forget Therion, Emperor,
The Gathering, Nightwish, Blind Guardian, Edguy, Children of Bodom, Rhapsody,
Sonata Arctica and I'll better stop here. :)

Are The Scorpions and Michael Schenker considered European metal? They were
some of my favorites. Lovedrive and Animal Magnetism are great rock
classics - I still have my vinyl copies around somewhere.

Okay, DFS, I'll divulge a little - I'm white, I'm over 30, and I have
just put on my mp3 of "The Eminem Show". No doubt I'm the exception
that proves the rule?

Despite DFS's assumptions, I'm not a rap "fan". The violent,
misogynist attitude can be tiring. But I do like early Ice-T stuff
(what he did before it became a cliche), and I like Eminem, as his
lyrics can be quite funny and clever, he does some neat stuff with
rhythm, and generally he doesn't adopt the violent attitude so
prevalent in rap. He rarely writes about guns and killing people. And
his misogyny is generally limited to humorous attacks on his ex-wife
and his mother. Sure, you hear one or two and you think it's the
usual. But if you know the context, and if you have knowledge of his
past work, you get the joke.

I'm not trying to intellectualize rap, and I'm not comparing Eminem's
"poetry" with the work of "real" poets. This is pop music. But it's
/clever/ pop music. And most rap /is/ crap, in my opinion. But good
rap is good.

Rap music originated in black neighbourhoods, and is usually performed
by black artists. And many white rappers /are/ crap. But rap is not
"black" music. The fact that Eminem does it well kind of proves my
point. Also, bands like Rage Against The Machine, with their rap-metal
fusion style, have helped broaden its appeal.

DFS is a great one for making offensive assumptions on the slimmest
evidence. A short while back, I failed to criticize someone for making
naive, idealistic comments about Africans. So Dumb Fucking Shit (as I
like to call him) decided that I must be black. And told me (I'm
paraphrasing) to fuck off to Africa if I thought it was so great there.

He has, apparently, eventually accepted that I am, in fact, white. So
now he thinks I'm a liberal "nigger-lover". He has also assumed that
I'm a teenager. Maybe he hasn't read the posts I've written about my
computing experiences in the 1980s, which would give anyone a clue as
to how old I am. Or maybe he's trying to wind me up. I don't know, or
care. The point I'm making is, DFS makes assumptions all the time,
using the SWAG* principle, while criticizing other people for doing the
same time. In short, he is a hypocrite. He is also a racist. And
he's a history revisionist and a Nazi sympathizer.

He tries to be offensive, but can only manage ridiculous. Still,
putting him in his place can be amusing.

I'd forgotten about RATM. Their first album (must admit, subsequent ones
were not really to my taste) was an absolute bombshell, one of the best I
ever heard.

Within those years, the software houses would have written for Linux.

The only problem is that the EU would still be daily attacked by the Windwos
zombies spewing out spam, viruses, etc, however, businesses would soon find
that the costs of virus, etc protection would be near zero and so billions
of funds wouldn't be needed for that and so could be diverted towards
conversion to Linux, or the share holders divvies.

That depends how you define "work". The reason the world[1] uses it is
because it comes bundled with the machine and is almost impossible to
reject, and all the wonderful donations to schools of MS powered equipment

pick Windwos?

Yes he can. It's pretty easy in this day and age actually. It wasn't
too hard 40 years ago either. It wasn't entirely impossible 200 years ago.
Some have it harder than others but that's true all over. The real question
is what you do about it and what the pervasive cultural values within your
own ethnic group tell you to do about it.

Hiow can a black person stop being black? I mean, apart from the obvious
Michael Jackson route? I'm not saying a black person can't alter his
values, his behaviour, that would be stupid. But society is still
very often going to perceive him in a certain way because of his skin
colour. And that's something he can't help.

We've had an interesting example in the UK for many many years. One of
our key newsreaders is a guy called Trevor McDonald. In spite of the
British name, he's a black guy from the Windies. When he was a kid, he
used to listen to the BBC, and decided he wanted to be a newsreader, so
he learnt the BBC accent, came to the UK, and did exactly that. He's been
a newsreader for donkey's years now, and is very well respected indeed.

There's been a view that accents are a kind of racist tool but they can
all be learnt if you want to enough.

There was another black guy who made a respectable living from having a
broad yorkshire accent, one advertisement he was in played on racism, it
went something like:

White guy:
"Bet you'd like to have these <product X> where you're from?"

Black guy (in strong yorkshire accent):
"Aye, but ah were born 'ere, lad."
