This forged post, another in a series, provides further proof
that their author is the person who uses the name "flatfish"
(among some 60 other fake identities). Evidence has been
posted identifying this individual as one Gary M. Stewart.

He has previously posted articles expressing his hatred of
homosexual people, and his belief that I'm gay (because I've
written in support of civil rights for homosexuals). The
forged post contains a derogatory sexual reference that he
thinks relates to gay men.

Please report this forgery and the others to
ab...@earthlink.net . Include a copy of the post with all
the headers; you can use the copy below:

I find it incomprehensible that the Judicial branch has degenerated to the
point that an anonymous pseudonym that has been in use for less than 12
months can possibly be libeled and defamed. (I cite the article below as
the earliest recorded use of the "flatfish+++" pseudonym. It is dated 19
Jul 2001, i.e. a little less than 9 months ago.) So, unless Mr. Bilk has
been sending you private harassing e-mail despite requests to stop, or Mr.
Bilk has obtained the street address, postal address, or phone number of
your household or place of employment and is presently harassing you in the
manner described, I suggest you drop any pretense of having a valid legal
case, flattie.


Earliest recorded use in Google of the "flatfish+++" pseudonym:

Note than many other instances exist of people using "Flatfish" or
variations on it on Usenet prior to that date exist -- in particular,
Google has record of a 1998 alt.movies spammer -- so I find it implausible
that flattie could demonstrate that he could be defamed, slandered, or
libeled by attacking the anonymous "flatfish+++" persona.


On the original note, however, I present the following evidence that the
forger that created this thread was NOT flatfish:

* The User-Agent in the post is reported as "Mozilla/5.0 (X11; U;
Linux i686; en-US; rv:0.9.8) Gecko/20020204", rather than
flattie's beloved "Forte Agent 1.9/32.560".

* Flatfish's modus operandi, "X-No-Archive: yes", is missing from
the forgery.

* The nail in the coffin: flatfish's recent posts seem to originate
with Optimum Online; the forger appears to originate at Earthlink.
To prove that the forger is flatfish, it would be necessary to
demonstrate that (a) flatfish owns an Earthlink account, and
(b) flatfish owns the specific Earthlink account that posted the
forgery.

handle then that is anonymity. And you can't sue for that.
Then there is the unwarranted provocation on your behalf.

It has been on the other foot, and I know exactly who the morons are on this
newsgroup. Interestingly, (and somewhat expectedly) stupidity seems to
have cast itself quite evenly among the two sides of the issue.
