Well you certainly don't mess about - Genuine Monotype, complete with
copyright notice as well. Any chance that you could get your message
cancelled as there are some of us who have ethics and don't like to
receive unsolicited pirated software? If you really must distribute
commercial fonts then please do so by email.

It's a commercial, copyrighted font and cannot legally be posted or
exchanged. I am taking steps to get At The Beach's post removed
(although it is not likely I can succeed), and would ask you to cancel
your own post. If you're using Netscape Navigator, you can cancel it
from the Edit menu.
Having said that, I can see you are still in a jam. Arial fonts are
presently posted in the TrueType section of Microsoft's web page; you
may find what you want there, and it is legal to download them. I
haven't looked recently so cannot be sure. Other than that, try and find
the Win3.1 software you got rid of, or find some someone else is not
using.
Just out of curiosity, why the anon identity in the same place as an
e-mail address?
Many fonts are freeware or shareware, and can be legally exchanged, but
the comp.fonts newsgroup is not for binary files. Please only post fonts
in alt.binaries.fonts.

On The Beach pointed out in private communication that a license to
Windows includes a license to the fonts in it, and said there should be
no impediment to replacing a lost or damaged font, any more than if it
were a lost or damaged DLL.
Assuming the semi-anonymous person who requested the font (and
should definitely not have requested that it be posted) still has a
valid Win 3.1 license (i.e., hasn't cancelled it or transferred it to
someone else) then is it OK to send him a copy of Arial? (I know it's
not OK to post Arial in a public place for free downloading.)

At The Beach responded by e-mail saying he has removed the post. He also
proposed an interesting justification, which I have encouraged him to
make public here.
The Win3.1 core fonts do NOT include Arial *Rounded*, which is distinct
from the Arial "with corners" included with windows.

I think it would be legal under the circumstances described above, but
if it turns out that the recipient didn't have a valid licence, who's fault
is it? Do you need to check the validity of the licence before giving away
the font? Since I'm not a lawyer, I don't know the answer.
In any case, some common sense should warn you to give away copyrighted
software to persons you don't know well:
Here in germany there is a famous lawyer, who asks you in a faked letter
(I'm a sixteen year old girl <photo included> and ask you to do me a favour,
please send me the following stuff on diskette...) for copyrighted software,
and after he receives it he sends you an _Abmahnung_ (cost you real money,
typically 2.000 DM) and threatens to sue you (which will cost about ten times
as much) if you don't pay promptly.

Just checked my WfWG machine here at work: no Arial Rounded. I'll have to
check at home this evening to see if it's there either from being bundled
with something or as part of an MS Font Pack.
Note that MS has now makes available on their ftp site Arial Black,
Impact, and Comic Sans, to accomodate those wishing to specify fonts in
their web documents. But no Arial Rounded.

Not that I remember. I got Arial Rounded MT when I bought
Microsoft Publisher. It was not part of either Windows 3.1 or
Windows for Workgroup 3.11. Only run of the mill Arial were
included in both Windows.

I believe that Arial Rounded comes with Word for Win v6, that is the only
machines that I have seen it on are the ones with WfW6 on them. It is not
supplied with Win3.1 OR WfWg3.11, to the best of my knowlege.

Because if there are alot of people out there who sometimes disagree
with things I say. That's some peoples own opinion and I have no
problem with that. But there are also people who disagree and think
they should get me (email bomb). I don't feel like bothering with
those types. If they have a problem with me they can send me an email
stating their opinion. just as you have. I don't need to clean up my
mail server because some idiot diagreed with me or just thought it
would be fun to email bomb a few people.

Opinions? Yeah - why not use one of the zillions off Swiss-lookalikes and
knockoff's. Arial may be a copyrighted font name, but the style exists in many
forms. Why not just send the poor guy the font in p.d. form? It's not exactly a
'new' or unique (grunge) style. I don't condone posting anything under
copyright, but in this case I truly don't see why we need to get all
anal-retentive about it.

Your post makes me wonder, though, about exactly how annoyed a company
like Monotype is really entitled to be if they sell all rights to
Microsoft, Microsoft in turn flings the fonts out into the marketplace
like leaves to the autumn winds, for all intents and purposes free, and
then users interpret this to mean the fonts in question are free.
Monotype probably assumed that as soon as they cashed Microsoft's
cheque, it became Microsoft's problem, and Microsoft (other than having
an end-user license agreement) behaves like they don't think it's a
problem.
I think it's worth reminding people that fonts aren't always free, don't
you? Is that a clinically valid symptom of anal retentiveness?
