We have received the following from the Law Commission:

The Law Commission is pleased to announce the publication of its second consultation paper on its review of the Arbitration Act 1996.

This second consultation paper makes proposals for law reform on an issue not covered in our first consultation paper: the proper law of the arbitration agreement. It also includes an update on our thinking on two areas covered in the original consultation: challenges to an arbitral award under section 67 of the Act on the basis that the arbitral tribunal lacked jurisdiction; and discrimination. We ask consultees for views on all three matters. 

The second consultation paper, and a summary, can be read on the project webpage. We would be very pleased to receive responses, and we encourage consultees to use the online response form. The consultation period is open until 23.59 hours on 22 May 2023. Thereafter, we will proceed to our final report with recommendations for law reform.
