I have reviewed the information forwarded to my by Deputy Director Carochi. I have also reviewed the current policy on Offender visiting, AR 300-1. The administrative head is the assigned authority to approve, deny, or inactivate names of visitors on visiting lists. An offender's visiting list shall be subject to the following restrictions: d. The following persons will not be approved for visits: 5. Current or Ex-DOC employees, private prison employees, contract workers, or private company employees who are providing hospital supervision assistance, who were not an immediate familiy member of the offender prior to incarceration or parole supervision. (This obviously is the grounds for denying my regular visits to my HUSBAND) The special visits therefor become relevant: C. Special Visits: 1. Special visits (to include extended visits) between offenders and their families may be granted for reasons such as: c. When a special visit is determined by the administrative head, or designee, to be in the best interest of the offender's rehabilitative needs or correctional goals. (I am his wife, I am trying to help him progress in a positive way and rehabilitate. He is in solitary and only receives visits from his mother for 2 or 3 days out of an entire year. It is in his best interests to be able to visit with me, and with him at CSP there is not even any contact, so it is the most controlled visiting situation possible.) d. Individuals who would not normally be approved to visit. The administrative head may require a non-contact visit. (it already is non contact and I cannot visit him normally because of this regulation) Further proof that visiting is in my husband's best interests is found in the regulation itself as stated: AR FORM 300-01E - Open Letter to Offender Visitors The Colorado Department of Corrections considers offender visits an exceedingly valuable correctional operation's feature. Visits are encouraged to the maximum extent possible within limited DOC employee and facility/center resources. DOC Employees intent to facilitate your visits in the most pleasant manner possible. Success of DOC employee effort will be dependent entirely on your cooperation. I have done everything I can to cooperate. At no juncture has DOC "encouraged to the maximum extent" my visits. In fact the opposite is true. I am asking for a special visit for myself for the Christmas holiday. Only you can approve this visit as shown in the AR and I am therefore requesting that you approve this visit and allow me to see my husband, on the grounds that a special visit is in his "best interest." It has been been "over a year." My visits were revoked and I have appealed it as specified in the AR. There is no greater control over a visit than the non contact visits at CSP. My husband has no other visits available to him at this time. It is in the best interests of our family to be able to have me be allowed to visit my husband. I would also further state that while doing legal research in conjunction with these issues, I have discovered and have had it further verified that in 35 states the visiting regulations specifically deal with the issue of previous DOC employees and in those 35 states, ALL OF THEM ALLOW VISITS, with a time frame from zero days of waiting period to 2 years.
