Hi Suresh,

 

I hope that you are doing well. As you may have seen, we issued a community alert (below) today with information on the case and encouraging individuals to contact the prosecutor’s office in calling for a robust investigation. This afternoon, I received a call from Bruce Kaplan in response to the letter that we submitted to his office last week (attached).

 

In our conversation, Kaplan mentioned he met with Dr. Sinha’s widow and supporters of the family and explained his investigation process. I wasn’t sure if you were at this meeting, but if you have more details or if there are outstanding questions from the meeting, feel free to let me know and we can follow-up. Although there was not too much that he could convey as the investigation is ongoing, he shared the following with me:

 

-      Regarding potential hate crimes charges, they are still looking at the evidence and concentrating on the suspects’ actions before, during, and after the incident (e.g. did they brag about the attack and, if so, what did they say? Were there comments that they made prior to the attack indicating targeting based on race/national origin? Did they send text messages or emails after the attack that indicate their motivation?) His office wants to do a thorough investigation of the evidence before deciding whether to file hate crime charges, which may take some time.

-      Regarding trying the suspects as adults, a decision should be made shortly (though, he could not specify a timeframe or what that decision was). He did add that any decision could be attacked by opposing counsel if it was based solely on community pressure, rather than the facts

-      Regarding racial tensions in the area, although filing hate crimes charges in Dr. Sinha’s case will be determined solely by evidence from that evening, he is interested in knowing more details about racial harassment occurring in the area. He wants to ensure that community members feel comfortable filing police reports when such situations arise and is interested in working with community leaders and organizations such that affected individuals can come forward. He also wanted to know if a training by the prosecutor’s office and police department on what a hate crime is and how to report it to police would be useful (feel free to let us at SAALT know if it would be and we’d be happy to assist in making that happen).

 

I’m not sure if he already conveyed much of this information to the family this morning, but I wanted to ensure you had this information. (Feel free to send this update over the Citizens of Old Bridge listserv, if that’s helpful.) We are still encouraging community members to let his office know that the community is concerned about this case. In addition, if you have any details of recent racial harassment cases in New Jersey that community members feel comfortable sharing, feel free to let us know so that their office can get a better sense of the climate in Old Bridge.

Community Alert: Demand Robust Investigation of Old Bridge
Fatal Assault

 

 

On the night of June 25, Dr. Divyendu Sinha was walking with his wife and two children in Old Bridge, NJ, when he was brutally assaulted by several teenagers. The 49-year-old scientist died a few days later as a result of severe head injuries sustained during the attack.

In the wake of the incident, local South Asian community members have expressed an increased fear of hate crimes and reported a history of racial tensions. Recent examples of bias and harassment include being spit upon and having trash thrown at them on a daily basis. In fact, such concerns were raised by over 200 residents in a town hall with Old Bridge Mayor John Phillips and law enforcement officials.

Since the incident, five individuals have been arrested and are currently facing various charges, including murder and conspiracy to commit murder. While facts are still emerging to determine whether the attack was motivated by Dr. Sinha's race, it is clear that community members are living in fear within the racially charged atmosphere of Old Bridge.

SAALT has submitted a letter to Middlesex County Prosecutor Bruce Kaplan and Mayor Phillips urging a robust investigation of the case to determine if race played a factor in the murder and encouraging the filing of hate crimes charges, if warranted by the facts.

SAALT also encourages community members to take the following actions:

·        Send a message to Prosecutor Kaplan urging a robust investigation and filing of hate crime charges, if warranted by the facts

·        Check out and share SAALT's "know your rights" factsheet for South Asian community on what to do if you are the victim of a hate crime

Suresh, Couple of weeks ago I received chain of emails where bunch of
people shared racial harassment incidents. Are Mr Kaplan or Mayor of
Old Bridge aware of those incidents?

Thanks for sharing this good news. I am convinced that the pressure from the residents of Old Bridge, inculding from may of you and from organizations such as SAALT played  a important role in this decision.
