Que ellas tienen su solucin y regulacin por el derecho de fondo, sin perjuicio de lo cual existe tambin un marco mnimo de tolerancias fijadas y adoptadas desde tiempo atrs por normas vinculadas al quehacer de la Agrimensura (Dec. 10.028/57), las que si bien no modifican el derecho de fondo, sientan en su mbito principios que luego son reflejados en los planos que se presentan ante el Registro de la Propiedad, una vez aprobados por los organismos competentes que tienen intervencin previa;
Que, por tales causas, resulta, a los fines de la matriculacin de inmuebles prevista en los artculos 10 a 13 de la ley 17.801, de sumo inters fijar la forma en que se han de reflejar tales situaciones para debido conocimiento de los terceros, tal como es el cometido de la funcin registral, de modo que sean ellos quienes conforme al derecho de fondo ya enunciado, adopten las medidas que consideren conveniente a sus derechos, ya que no corresponde a este organismo modificar los derechos inscriptos ni su extensin;
Que para ello se ha de observar el siguiente proceder registral para esas hiptesis: 1) En todo caso se ha de reflejar en el rubro 4 de los folios reales, la existencia de demasas segn resulte de la mensura trada, con respecto a la superficie consignada en el asiento antecedente; 2) En los casos en que esa demasa no exceda el 5" de la superficie total, para lo urbano y el 1" para lo rural y subrural (Tierra del Fuego, Antrtida e Islas del Atlntico Sur), se ha de "absorber" dentro de la superficie, sin :.)perjuicio de lo indicado en el punto anterior; 3) En los casos en que la demasa exceda el 5" de la superficie total para lo urbano y el 1" para lo rural y subrural, el plano deber "ubicar" la superficie excedente, la que no ser motivo de inscripcin hasta tanto se obtenga el ttulo jurdico pertinente tal como impone el Artculo 3: de la ley 17.801 y concds. del C.C. sin perjuicio de lo indicado en el punto 1) en cuanto al aviso a terceros, de la existencia del excedente;
Que el anlisis de los casos enunciados hace aconsejable, adems, distinguir estas hiptesis de aquellas que consisten en "variantes" emergentes del plano de mensura, con relacin al ttulo inscripto al que se refieren, pero que no son variantes en el rubro superficie, sino en cuanto a los linderos, rumbos, medidas lineales, angulares o algn otro aspecto vinculado con la determinacin de la cosa, puestos que en estos casos corresponde la toma de razn de tales variantes sealando nicamente la fuente documental de la que resultan para debido conocimiento de los terceros;
Que procede, en consecuencia, el dictado de la medida pertinente para lo cual se cuenta con la opinin favorable del Colegio de Escribanos de esta Capital, de acuerdo con lo establecido por el artculo 6, inciso a), del convenio vigente para la aplicacin de la ley 17.050; Por ello,
