Good morning Bill—

 

Councilman Tackett and I have been approached by one of my constituents about a change regarding electronic sign practices from the current 14 hours per message to something that would allow a change much more frequently (to be determined).  I am wondering if the Civic League has a position on frequency of message changes for electronic signs? 

 

The community association in question, Brookside, is investigating buying an electronic sign for its community center and because the association hopes to do multiple rentals and events on the weekend, would like to be able to change the message for each event.

 

Any feedback that you could give us on this matter would be greatly appreciated.

First to start with, to respond with a direction or position from the CLNCC without having first having a discussion with the CLNCC board and members, would be inappropriate. So I would first state that this needs to be put on the meeting agenda for the February meeting to be talked about and recommendations presented
by the membership.
 
Secondly, to get a variance would be precedent setting for others seeking to have their Electronic Variable Message (EVM's) signs/boards cycle messages more often than the currently permitted twelve (12) hours before changing, other than time and temperature displays.
 
Third, the whole EVS ordinance needs to be revisited as it doesn't differentiate between for profit businesses and non-profits, such as community centers and fire halls, etc.  I would be opposed to allowing any commercial business with an EVS from having the ability to cycle their display to anything more than once per eight (8) hour cycle, but would be willing to allow any bona fide non-profit organization, such as a Fire Company and their function/banquet halls, Community Centers, churches, etc. (they would have to be a 501 IRS registered non-profit) and allow them to change their message signs every two (2) hours AND allow them to receive and display Amber Alerts from the DE State Police agency that transmits such messages.
 
The key is to have the ordinance clearly define that to be considered a "non-profit" the group or organization that owns the property the EVS is located on, must be a IRS registered (in good standing) 501 type of organization. You can drill into the various (c)3, etc. to establish a clearer definition, if needed.
