THis is regarding AB5 and 2557 for independent contractors.  Do entertainers such as opera singers or actors, etc qualify as independent contractors when they perform for a bunch of different companies or locations?

See page 3.09.08 in the BB. However, if I were you I would not be giving that advice.  That is the employer’s decision and a legal one. If push come to shove the one giving the advice is subject to the same penalties as the employer.  I would simply say it is the employer’s decision.  If the client gets a 1099-NEC treat it as Sch. C., W-2 then wages.
