HI, a colleague and I have a disagreement. This might be more of a legal question, so feel free to tell me to take a hike, but if anyone has any input, I’d welcome it.
Take a business with fewer than 50 full-time equivalents, which is not required to offer health insurance. If that company chooses to, I believe it can structure the plan to include certain groups of employees and exclude others as long as it does not do so using discriminatory criteria, e.g. gender, race, etc. For example, the policy could include management but exclude clerical staff. Or it could offer insurance to salaried staff but not hourly. My colleague says that if it’s offered to one, it must be offered to all, otherwise businesses would tend to provide insurance only to ownership and other high-ranking employees. But I think many companies do just that! Any thoughts? Thank you.
