Wight Didn't Believe Damages Exceeded $1 Million

"I don't know that the dollar amount is, I've been busy on a project
for the city of Houston, but I don't think it's that much," Wight said
when asked if the $1 million figure was accurate.

There are other articles with Galv. Daily News where Wight is quoted
as saying he doesn't know the value of the land. Articles with Fwd
Journal stating he didn't try to mitigate damages and market the
land. He admits he continued with dirt work even after the lawsuit
was filed. He stopped working on the property according to my read of
the reports after the Austin Court ruled.

Wight's position necessarily makes the City argue that the alternative
is if he is correct and the contract legal, then the councilmembers
are personally liable. From the reports, it does not appear that he
sued the councilmembers directly but his theory of the case
necessarily implies that they have to be personally liable. The
attorney that filed the suit is not the attorney that represented
Wight in the contract negotiations.

"Developer David Wight went ahead and had the earthwork finished
recently, if only because it had already been paid for long before the
judge's ruling stopped the project.

"We had been working on it, not many guys, just a few, and mainly just
for my benefit," Wight told The Friendswood Journal. "Since it was
already contracted, I thought why not finish this part of it at
least?"

and later:

"Wight said he spent thousands fulfilling his part of the agreement."
