Some people have asked questions on why the Mayor cannot be impeached/
recalled NOW. There could be an effort to have it declared that he
has forfeited his office by violating the Charter. However, given
past actions, it is believed that there will not be an agreement that
there was a forfeiture and litigation would be necessary. Litigation
probably would not be resolved by November.
The City Charter allows for recall but not until 6 mos. after
elected. The Charter can be viewed on
www.municode.com. The Mayor was
elected May 9, meaning recall efforts will have to be around November
9. I do not know if anyone has researched whether there are State
laws that could remove him from office sooner. If he does not resign
soon and recall efforts are commenced and successful, the City will be
forced to spend money on a special election rather than holding a
mayor election on November 3. As such, there is a little time for
those that want to organize a recall effort.
