to City of Friendswood vs Citizens of Friendswood
I believe the PRAYER Councilman Barr so strongly addressed during the
9-14-09 council meeting is the following, unless an amended prayer
exist somewhere else. Nonetheless, assuming this is the PRAYER in
question, why is Councilman Barr so confused, especially since it does
mention "the purchase of the park land in Brazoria County" and the
judge denied the "PRAYER."

VII. PRAYER
"The City respectfully requests that the court declare the issuance of
the Proposed Public Securities, in the form and manner described
herein and in the City's Amended Petition, as legal and valid under
all applicable laws. The City also requests that the court declare the
proposed expenditures, including the purchase of the park land in
Brazoria County, as legal and valid under all applicable laws.
Finally, the City requests all other relief named in its Amended
Petition and all other relief to which it may
be entitled."

FINAL JUDGEMENT
"The court called this case for trial on July 14, 2009, at which time
the City of Friendswood and five of its citizens (Janis Lowe, Deborah
Winters Chaney, Mel Austin, Kathy Rogers and Leslie Roque), self-
identified as the Friendswood 5, announced ready. The Attorney General
of the State of Texas also appeared. Trial was to the court, which
heard evidence and argument of counsel.
After consideration of the evidence and the arguments of counsel, the
court hereby rules in favor of the 5 citizens and against the City of
Friendswood.
It is therefore ADJUDGED, ORDERED, and DECREED that the relief sought
by the City of Friendswood is DENIED, and the City of Friendswood
TAKES NOTHING by reason of this suit. Costs of court are taxed against
the City of Friendswood. This judgement is full and final; it disposes
of all claims. All relief not expressly granted is denied."
