San Diego Superior Court judges rules that SANDAG in violation of California environmental laws

On Monday, December 3, Superior Court Judge Timothy Taylor ruled that SANDAG was in violation of California state law but not taking into account air pollution and greenhouse gas emissions in its Draft Environmental Impact Report for the $200 billion plus RTP 2050 40 year regional transportation plan.  A lawsuit filed by the Cleveland National Forest Foundation, Center for Biological Diversity and Sierra Club, later joined by California Attorney Kamala Harris, may now proceed.

 

This is a stunning victory for those of us who feel that the 40 year plan for the expansion of I-5, which is still in effect and may begin as soon as next year, is untimely and unwarranted.  The 11,000 pages of DEIR for the original I-5 project have been reviewed by Caltrans and they will publish their answers next year.  Caltrans officials have already stated that they will “successfully” (in their own opinion) answer all of the thousands of comments they received.
