TERMS AND CONDITIONS – Fear Factor Khatron Ke Khiladi Level 2
(“Audition”)
Fear Factor Khatron Ke Khiladi Level 2 is an adventure based reality
show where the final participants shall be required to perform and
excel in stunts which are dangerous in nature and causing aversion, to
emerge as the winner. Only those Applicants who are physically fit and
without any history of mental illness are requested to apply.
1. This Audition is organized by Endemol India Private Limited
(hereinafter referred to as "Organizers" for selection of participants
for the adventure based re
ality show “Fear Factor Khatron Ke Khiladi
Level 2” which is proposed to be produced by the Organizers (‘Program’)
and is open for all Indian nationals who are between 18 to 35 years of
age and holding a passport which is valid for atleast 1 year from the
date of Application ("Applicant").
2. For a chance to participate in the Audition, the Applicants have the
following options:
Log on to www.colorstv.in/kkk2 and complete the online application
form.
Download a copy of the Application Form available on
www.colorstv.in/kkk2 and send the application to the address of the
Organizers provided at the end of this page along with your photograph.
A copy 20of the Application Form as may be made available through
newspapers or magazines as per discretion of the Organizers can also be
filled up and submitted along with your photograph.
3. Only those applications for Audition completed and submitted with
all necessary requirements as specified therein by the deadline/cutoff
date as shall be informed/advertised by the Organizers through public
media shall be considered for selection of participants for the
Audition.
4. The Organizers decision regarding the selection of the Applicant for
the Auditions shall be based on their application and shall be as per
the discretion of the Organizers which shall be absolute and final. The
selection process ma
y vary as per the Organizer’s sole discretion. The
Applicant or any third party shall have no right to question any stage
of the process of selection or non selection of any Applicant for the
Audition or the Program.
5. Employees of the Organizers and/or Viacom18 and/or their associate
and affiliate companies/ the respective contest sponsor, will not be
qualified for the participation in the Audition. Pregnant women are not
allowed to take part in the Auditions or the Program keeping in mind
the nature of the Program.
6. The Organizers reserve the right to change/ modify terms and
conditions and/ or criteria of the Audition, at any time at their own
discretion and without 20any prior notice and without assigning any
reason.
7. The decision of the Organizers in connection with the Audition will
be final & binding and is non-contestable. In case of any dispute or
difference in respect of this Audition, the decision of the Organizers
shall be final and binding on all concerned.
8. The selected Applicant shall be intimated directly by the Organizers
either by a personal medium like phone, e-mail or by post. The
Organizers shall not entertain any questions, correspondence, and
enquiries on the selection, the manner of conduct of the Audition or
any other information regarding the Audition from the Applicant(s) or
any other person whatsoever.
9. Apart=2
0from the entitlement to be part of the Program if selected,
the Applicant or his/her legal heirs will have no other rights or
claims against the Organizers.
10. The terms of the Audition shall be subject to jurisdiction of
competent court/s at Mumbai alone.
11. Submission of the application for participating in this Audition
implies acceptance of all the terms and conditions hereunder. By
submission of the application by the Applicant shall also constitute
permission for Organizers, and its affiliates to click photographs,
record videos of the Applicant and use the Participant’s name,
photographs, likeness, voice and comments for advertising and
promotional purposes in any media worldwid
e and in any way as per
discretion of the Organizers throughout the world in perpetuity without
any compensation to the Applicant whatsoever.
12. Any photographs, videos etc. submitted to the Organizers during the
Audition and along with the Application shall on submission become the
property of the Organizers and shall be available to the Organizers for
exploitation throughout the world in perpetuity. The Applicant shall
ensure that the photos or videos submitted by them in any public domain
shall not be obscene, vulgar, defaming, denigrating women or children,
hurting religious sentiments, depicting violence or shall not infringe
the rights of a third person.
13. In the event of any vio
lation to the aforementioned or in case it
comes to the knowledge of the Organizers that the details submitted by
the Applicant in the application are not correct, the Applicant shall
immediately be disqualified from being considered to be a participant
for the Auditions and shall solely remain liable for any action
(criminal/civil) arising there from.
14. The Applicant hereby agrees to indemnify the Organizers against any
claims that might arise from their actions or omissions or arising from
any representations, misrepresentations or concealment of material
facts.
15. By virtue of submission of the Application for this Audition, the
Participant agrees to the terms and conditions hereinabove a
nd
undertakes to abide by the same.
ON SELECTION OF THE APPLICANT TO PARTICIPATE IN THE AUDITION THE
APPLICANT/PARTICIPANT AGREES TO THE FOLLOWING TERMS & CONDITIONS:
1. Those Applicants who are selected for the audition shall be informed
of his/her selection either by e-mail, phone or post (“Personal
Medium”). The Organizer shall not be liable in the event the Applicant
is not able to participate in the Audition due to any delay or non
receipt of such invitation to the Applicant.
2. Those Applicants who are selected shall be informed by the
Organizers of the Audition shall report to such venue as may be
informed by the Organizer at the date and time so mentione
d and any
delay in reporting shall automatically disqualify the Applicant from
participating in the Audition.
3. All costs incurred by the Applicant including but not limited to
traveling, accommodation or food and the arrangements for the same
shall be the responsibility of the Applicant and no claims for the same
shall be made against the Organizers.
4. All Applicants shall be required to execute an agreement or sign a
form containing terms and conditions as required by the Organizers
before allowing to participate in the Auditions.
5. All Applicants/Participants shall maintain the decorum of the
Audition venue and shall abide by the rules and regulations thereof.
Further the ins
tructions of the Organizers shall be adhered to
strictly. Any Applicant/Participant who acts in contravention to the
instructions of the Organizers or creating nuisance either to the
Organizers or the other Applicants shall immediately be disqualified
from participating in the Auditions and shall be escorted outside the
Audition venue.
6. The decision of the Organizers in connection with the Audition
including but not limited to short listing the Participants will be
final & binding and is non-contestable. The short listing process of
the Participants shall include but not be limited to their qualities
like presence of mind, physical fitness, attitude etc. and such
filtering and selection process
shall be the sole and absolute
discretion of the Organizers as per their creative requirement for the
Program. The Participant shall not question such process. In case of
any dispute or difference in respect of this Audition, the decision of
the Organizers shall be final and binding on all concerned.
7. The Organizers shall shortlist Participants after the Auditions at
all venues as required out of which only a limited number of
Participants shall be selected after further interviews with Vicaom18
representatives to participate finally in the Program. Even after final
selection for the Program, the Organizers and/or Viacom18 shall have
the absolute right to replace any of the participants as
per their
discretion and creative requirement.
8. Each short listed Participant might be required to enter into a full
form agreement with the Organizer or Viacom18 and in case of failure to
enter into such agreement; the Organizers or Viacom18 shall have the
option to replace the Participant.
9. The selected Participants shall be intimated by the Organizers
directly by Personal Medium. The Organizers shall not entertain any
questions, correspondence, and enquiries on the manner of conduct of
the Audition from any person whatsoever.
10. Apart from the entitlement to be part of the Program the
Participants or his/her legal heirs will have no other rights or claims
against the Orga
nizers.
9. Any disputes pertaining to the Audition shall be subject to
jurisdiction of competent court/s at Mumbai alone.
10. All Participants shall carry a copy of their driving license (Two
and Four wheelers) and passport along with the originals for
verification. Both documents should be valid for a minimum of 1 year
from the date of Auditions.
11. Participation in this Audition implies acceptance of all the rules
set forth by the Organiser for the Audition and the Terms & Conditions
herein contained. Participation in the Audition also implies the
permission for Organizers, and its affiliates to click photographs,
record videos of the Participant and use the Participant’s name
,
photographs, likeness, voice and comments for advertising and
promotional purposes in any media worldwide and in any way as per
discretion of the Organizers throughout the world in perpetuity without
any compensation to the Participant whatsoever.
12. On request of the Organizers, the Participant shall also make
arrangements for the Organizers to have access to his/her residence,
work place, favorite hangouts, pets etc. and obtain necessary
permissions from his/her parents, siblings, friends, colleagues to be
photographed, interviewed and to record or click their photographs,
videos etc.
13. Any photographs, videos etc. submitted to the Organizers or
recorded by the Organisers during or subsequ
ent to the Audition as
aforementioned shall on submission/creation become the property of the
Organizers and shall be available to the Organizers for exploitation
throughout the world in perpetuity.
14. The Participants shall ensure that the photos or videos submitted
by them in any public domain or their performances shall not be
obscene, vulgar, defaming, denigrating women or children, hurting
religious sentiments, depicting violence or shall not infringe the
rights of a third person.
15.The Participant hereby represents that he/she is not under any
exclusive contracts with any other third party/ agency or is not under
any kind of disqualification under law to enter into an agreement with 0D
the Organizers or Viacom18 as the case may be.
16.The Participants shall at all times shall keep confidential the
selection process and all details regarding the Program which he might
be informed of or which he might learn or come to know of as a
Participant in the Audition or as a short listed potential candidate.
The Participant shall at no time communicate to any third person or the
media or give any interviews on his/her participation in the Audition
or potential participation in the Show without prior written consent of
the Organizers and/or Viacom18.
17.In the event of any violation to the aforementioned or in case it
comes to the knowledge of the Organizers that the d
etails submitted by
the Participant in the application are not correct, the Participant
shall immediately be disqualified from being considered to be a
participant for the Auditions or for the Program and shall solely
remain liable for any action (criminal/civil) arising there from.
18. The Participant hereby agrees to indemnify the Organizers against
any claims that might arise from his/her actions or omissions or

undertakes to abide by the same.
