We are glad to inform you that Senator Nilofer Bakhtiar has confirmed that Domestic Violence Bill would be presented in the Senate of Pakistan on Monday February 20, 2012. The Senate session would start at 4 pm. We request you all to join us in front of Parliament House on Monday at 3:30 PM to show solidarity and support for this very important bill.

 

Those who have sent in their names with ID card Numbers, I have forwarded their details to the concerned authorities. Please note that passes will be available at the gate of the Parliament House. It should also be noted that those who did not provide their CNIC numbers, (or the provided number is not correct) would not get security clearance. I have sent emails to those persons individually.

I am glad to share that Protection of  Women from Domestic Violence Bill 2012 has not only been presented, but also passed unanimously by the Senate of Pakistan. Let us thank all the people and organizations that played a role in the lobbying for the bill. Congratulations everybody… Keep up the good work.

Here is my response to your questions:

 

·         As the previous bill (approved in August 2009 by the National Assembly) lapsed, that needs to be presented in the joint sitting of the Parliament. This is a new bill (though the same draft with very minor changes) presented by Nilofer Bakhtiar. It needs to be approved by the National Assembly before it is sent to the President for his approval.

·         This bill has been kept ICT specific because Women’s issues are a provincial subject now (after 18th Amendment).

·         It is the more or less the same bill. We (Bedari, Cavish and Bardasht) had held a Dialogue with Parliamentarians on 2nd February 2012 on this issue. It was agreed by the participants (including senators, civil society representatives and lawyers) that we need to remove the clause that asks for a fine of Rs 50,000 if the case is not proved in the court. I have not seen the final draft presented (and approved) in the Senate. I am trying my best to get hold of it. Only then we can see if that clause has been dropped or not.

This is indeed a good news and wonderful precedent. 

Few clarifications and points if any one of us or Marvi can updated on us

  • Does this bill now goes to NA for approval?
  • Why this bill was kept ICT specific? though after 18th amendment provinces are empowered to legislation but is there any move in this regard
  • Third is about the 'DV bill' as I was wondering whether this was same which was presented by Sherry Rehman or incase a different one than does it went through a consultative process among CSOs...

There is certain confusion in recent legislation regarding its promulgation in Islamabad Capital territory only, as reported in some newspapers. This has been first law passed by Parliament after 18th amendment. In my view the Parliament represents the whole of Pakistan and such legislation was being demanded by CSOs since long after the rising number of domestic violence cases across the country. If someone among us know about the exact situation, pl let us know timely so as we can raise voice accordingly. If it is for ICT only then we should have collective voice for the similar action and demand at provincial level. However legal position of the federal government need to be clarified first
